1. About This Privacy Policy

This 313 Presents, LLC Privacy Policy (“Policy”) explains how 313 Presents, LLC (“313 Presents”) and its affiliates (collectively, “we,” “our,” or “us”) collect and process personal data about individuals in connection with our interactions with you and through our products and services, including through our websites, apps, stores, and other digital platforms (the “Online Services”) and our events and programs at our arenas, stadiums, theaters, amphitheaters, and other venues (together, the “Services”). These locations include, but are not limited to, Little Caesars Arena, Fox Theatre, Comerica Park, Pine Knob Music Theatre, Meadow Brook Amphitheatre, and Michigan Lottery Amphitheatre. The Policy describes the type of personal data we obtain, how we may use the data, to whom we may disclose it, the choices available regarding our use of the data, and other information about our privacy practices.

By using any of the Services, you consent to the terms of this Policy, as they may be amended from time to time.

2. Data That We Collect and Receive

When you interact with us through the Services, we may collect data from you or from other sources. This data may be information that you directly provide to us, such as personal information you provide when from your interactions with 313 Presents and our provision of the Services, including online and/or while attending an event, concert, or other program, or information that is passively or automatically collected from you, such as information collected from your browser or device. We also obtain your personal data from other sources, including our affiliates, our partners, our customers, our vendors, third-party online services, social media platforms, and public sources. This data may include sensitive personal information.

The data we collect may consist of:

  • Contact Information. This data will vary, but typically consists of your first and last name, email address, postal address, government identification, phone number, date of birth, and other similar contact data and unique identifiers. We also receive data from the communications you send to us, such as customer service inquiries, product reviews, and other feedback regarding the Services.
  • User Credentials, such as username, user ID, password, password hints, and similar security information used to create an account and authenticate users of the Online Services.
  • Demographic Data, some of which may be protected classifications under State or federal law, such as age and gender.
  • Payment Data, such as credit card information and billing address.
  • Device Data, such as type of device, operating system, and other software installed on the device, device settings, IP address, device identifiers, name of internet service provider, and error reports.
  • Internet or Other Electronic Network Activity Information, such as clickstream data, sites visited before and after you visit a 313 Presents webpage, data about the programs and features you access and the advertisements you have been shown and/or clicked on, items you purchase, and the timing, frequency, and duration of your interactions through the Online Services, and other data about usage of the Services.
  • Commercial Information, including the tickets, services or products you purchased, obtained, or considered, and other purchasing, transferring, or consuming histories or tendencies.
  • Location Information, including general location information and geolocation data, such as IP address information to determine the country, state, and city your device is located.
  • Information about Your Interests and Preferences, such as your favorite music genres, performers, your home city, or your communications preferences. In addition to what you provide directly, we may infer your interests and preferences from other data we collect, such as the content you interact with while using the Online Services or when attending an event or performance at 313 Presents venue.
  • Third-Party Integrations. If you connect your use of the Services through a third-party service (e.g., a social media platform or Ticketmaster), that third party may share certain information from your third-party account with us.
  • Professional and Educational Information, such as level of education obtained, job title, industry sector, and company name.
  • Online Account Information, including social media information, which we receive from third-party online services (e.g., social media platforms) when you connect your use of our Online Services through their services.
  • Other third-party data, such as data from our affiliates, partners, data brokers, or public sources.

3. Automated Data Collection

When you interact with our Online Services, we may obtain certain information by automated means, such as through cookies, web server logs, web beacons (including pixels and tags), technology to review how you interact with us online, scripts, and other technologies. These technologies may help us:

  • To remember your information so you do not have to re-enter it;
  • To track and understand how you use and interact with us and the Online Services;
  • To provide you with advertising for products, services, tickets, programs, or events that might be of interest to you;
  • To tailor the Online Services to your preferences;
  • To authenticate your identity, protect against fraud, and provide our products and services; and
  • To otherwise manage and enhance our products and services and help them work properly.

We may use these automated technologies through our Online Services to collect information about your device, browsing actions, usage patterns, and location, including you device IP address, location information, unique device identifiers, device characteristics and settings, and operating system type and version. We may obtain information about your interactions with us online, such as the 313 Presents pages you visit, links you click, emails you open, referring or exit URLs, frequency and duration of your interactions, and other information about your interactions with our Online Services.

Your browser may tell you how to be notified about certain types of automated technologies and how to restrict or disable them. By disabling or restricting some or certain automated technologies, you may not be able to use all of the features of our Online Services. Please see the Cookies and Similar Technologies section of this Policy.  

4. How We Use Personal Data

We may use the personal data we collect for the following purposes:

Operating our business. We use the data we collect to operate our business, including providing and improving the Services. Specifically:

  • To deliver location-based products and services and comply with territorial restrictions.
  • To enhance and personalize guest experiences and enjoyment when using our products and services, including 313 Presents-owned and operated platforms.
  • To better understand our customer preferences when using our products and services, including 313 Presents owned and operated platforms.
  • To provide our Services, such as to sell you tickets to events and fulfill other transactions that you request, diagnose and fix problems with the Online Services and Services, and provide other customer support services.
  • For analytical purposes, such as to better understand our customers and other individuals and how they use the Services.
  • To customize, measure, analyze, improve, and expand the Services, to better understand the events to which customers and other individuals will be most interested in purchasing tickets, and to tailor our content and layout based on the data we have about how our customers and other individuals use the Services.
  • To compile, deidentify, or aggregate personal data for our business purposes.

Communicating with you. We use the data we collect to communicate with you, including:

  • To respond to your request or inquiry if you contact us.
  • To provide information about your account, your use of the Services, or other transactions that you request.
  • To deliver news, updates, and other types of communications, according to your subscriptions, alerts, and other preferences.

Marketing and Advertising. We use the data we collect for marketing or advertising purposes, on behalf of ourselves, as well as our partners and other third-party affiliates. Specifically:

  • To send you promotional messages, notify you about special offers, and deliver advertisements about products, services, programs, or events that may be of interest to you. These may be offered by, or on behalf of, 313 Presents, our affiliates, or by our partners and other third parties with whom we have a relationship.
  • To conduct internal and market research, identify usage trends, and determine marketing and advertising campaign effectiveness.

The promotional messages and advertisements that you see may be determined by data that we collect or receive about you, such as your demographic data, location data, usage data, interests, and preferences.

Security, Compliance and Enforcement. We use the data we collect for security, legal, regulatory, compliance, and enforcement purposes. Specifically:

  • To protect the safety and security of our customers, ourselves, our venues, performers, or others.
  • To detect and prevent abuse, fraud, or other unlawful or unauthorized activities.
  • To resolve disputes.
  • To comply with legal and regulatory obligations.
  • To enforce our agreements, including our policies and terms of service that govern your use of the Online Services and Services.

We also may use your data in any other manner as disclosed at the time of collection, or when we have otherwise obtained consent. We may also aggregate, merge, co-mingle, or otherwise combine personal data for the uses described above.

We use the personal data for these purposes because we have a legitimate business interest in providing our Services to our customers and other interested individuals. In accordance with applicable law, we take measures to help balance the interests we pursue with your interests, rights, and freedoms.

Where we have a contract with you, we process your personal data as necessary to perform our contractual relationship with you, provide our Services, and manage our customer relationships, including for the following purposes:

  • Operating our business, including:
    • To create and maintain accounts, as well as process your registration for our events and other Services.
    • To complete transactions that you request.
    • To diagnose and resolve problems with our Services and provide other customer support services.
  • Communicating with you, including:
    • To respond to your request if you contact us with a question or concern.
    • To provide information about your account, your use of the Services, or other transactions that you request.

5. How We Share and Disclose Data

There are times when the personal data we collect may be shared. We may share your personal data for the following purposes:

With NBA Entities. We may share personal data among the entities with 313 Presents’ affiliates that are the NBA Entities, including but not limited to the Detroit Pistons Basketball Company, LLC (“DPBC”), for purposes consistent with this Policy. For these purposes, the “NBA Entities” means, as applicable, the National Basketball Association (“NBA”), the Women’s National Basketball Association (“WNBA”), the NBA Gatorade League (“G-League”), the NBA 2K League, their respective teams, and each of their respective affiliates, including among the 313 Presents entities.

With Detroit Pistons Basketball Company, LLC, Pistons Sports & Entertainment, LLC (“PSE”), Ilitch Sports + Entertainment (“ISE”), and/or Olympia Entertainment, Inc. (“OEI”). We may share personal data with our affiliates DPBC, PSE, ISE, OEI, and/or other affiliated entities for purposes consistent with this policy.

Providing the Services. We sometimes engage or partner with other entities who operate the Services or perform certain functions on our behalf. We disclose personal data to vendors and other business partners to perform services for us on our behalf, such as support services related to technology, communications, payment processing, advertising and marketing, analytics, automated chat providers, fraud and security, and customer relations.

With Third Parties. In some cases, we work with third parties to operate certain Services on our behalf. These third parties collect, use, and access your data to perform their functions, and we may allow them to use information about you in accordance with applicable law to perform their functions.

Marketing and Advertising. We may disclose personal data to certain business partners for advertising and marketing purposes, including so that they can provide individuals with special offers, promotions, and other materials that may be of interest to them. We may also use third parties to serve advertisements in connection with online Services and on third-party platforms. These third parties may set their own cookies or similar technologies to collect information about users’ online activities over time and across apps and websites. Please see Your Choices and Rights section for additional information on the rights to opt out of these disclosures of personal data.

As Organization Restructure. In the event of a sale, merger, acquisition, reorganization, or similar event, or in contemplation of such an event (e.g., due diligence), your data may be among the transferred assets.

When Necessary Under Certain Circumstances. We may disclose your personal data when we believe such disclosure is necessary to:

  • Comply with applicable law or respond to valid legal process.
  • Protect the safety and security of our fans, employees, other individuals or entities, or the Services.
  • Prevent fraud, abuse, or other unlawful or unauthorized activities.
  • Protect the rights or property of us or third parties, including enforcing the terms of our agreements.

With Your Consent. We may also share your data for any other purpose as disclosed at the time of collection, when we have otherwise obtained consent, or when you direct us to share you information, such as when you use interactive features.

We also may use and share data in a manner that does not identify you (for example, information that has been aggregated with other records or anonymized). 313 Presents does not sell your information to third parties.

6. Third-Party Products and Services

Certain online Services may contain links to, or integrations with, other websites, platforms, applications, or services that are not operated or controlled by 313 Presents (collectively, the “Third-Party Products and Services”). For example, there may be a link or access to third parties that provide transportation services, restaurant reservations, parking reservations, and payment information and functionality. We also may allow you to access social media sites or Google products and services (e.g., Google Maps) through the Services. Third-Party Products and Services are not subject to this Policy, and we are not responsible for their privacy or data protection practices. For more information on how those Third-Party Products and Services collect, use, and share data, we suggest that you contact the operators of those Third-Party Products and Services directly.

Social Media. When you engage with our content on or through third-party social networking sites, plug-ins and applications, you may allow us to have access to certain information from your social media profile (e.g., name, e-mail address, photo, gender, birthday, location, your list of friends, people you follow and/or who follow you, your posts or “likes”) to deliver the content or as part of the operation of the application. We may also obtain non-personally identifiable information (e.g., content viewed, game performance, high scores, and information about advertisements within the content you have been shown or may have clicked on) from your interaction with our content. We may combine information which we obtain through social networking sites or applications with information we obtain directly through 313 Presents websites or from other sources.

In some instances, you may be able to link an account from a social media platform (e.g., Facebook, X, or Instagram) to an account through our Services. This may allow you to use your credentials from the other site or service to sign into certain features on our Services. If you link your account from a third-party site or service, we may collect information from those third-party accounts, and any information that we collect will be governed by this Policy.

When you allow us to access information from your social media account, it can enable us to do things like (1) deliver exclusive content to you, (2) personalize your online experience with us within and outside our applications or websites, and (3) contact you through the social networking sites or directly using your contact information. By engaging with our content through social networking sites or applications, you consent to the use of this information in accordance with this Policy.

Social media providers may also be able to collect information about you, including your activity on our Services. Your interactions with any such social media platform is governed by the privacy policy of the company providing the relevant service.

7. Text Messaging

The following terms and conditions apply to any one-time or recurring text message communication between you and 313 Presents.

Eligibility. You must be 18 years or older, or at least 16 years old and have the express permission of a parent/guardian, to receive text messages from 313 Presents. You must also be a U.S. resident.

Sign-Up. 313 Presents may provide you with an opportunity to opt in to receive special offers and other communications via text messages on your mobile phone.

Consent. By providing your mobile phone number and opt-in consent, you expressly and unconditionally consent to receiving one-time or recurring, autodialed text messages at your mobile number, including short message service (SMS) messages.

Charges. Standard carrier message and data rates may apply. Please check your mobile service carrier’s pricing plan to determine the charges associated with sending and receiving text messages. All charges are billed by, and payable to, your wireless carrier.

Wireless Carriers. Text messaging may not be available via all wireless carriers. Text messages may not be delivered if your mobile device is not in range of a transmission site, or if sufficient network capacity is not available at such time. Within any wireless carrier coverage area, there are factors beyond the wireless carrier’s control that may interfere with text message delivery.

313 Presents and its affiliates will not be liable for any loss or damage arising from or in any way connected with (i) non-delivery or delayed delivery of a text message; (ii) inaccurate or incomplete content in a text message; or (iii) use or reliance on the content of any text message for any purpose.

Third parties can send SMS text messages disguised as alerts and text messages from 313 Presents and its affiliates, and therefore you are advised to independently verity the authenticity of any text message that you receive.

Opt-Out. Note that by electing to opt-out of receiving further text messages from 313 Presents, you are not providing notice or a request for us to delete your information unless specifically requested in accordance with the process set forth in this Policy and permitted under applicable law.

8. Your Choices and Rights

You may have certain rights and choices regarding how we collect, use, disclose, and otherwise process your personal data.

Communications choices. You can choose whether you wish to receive promotional messages from 313 Presents and our affiliates, and which types of messages you wish to receive. If you receive promotional messages from us and would like to opt out, you may do so by following instructions within those messages or by emailing us at newsletter@313presents.com. Please note that these preferences do not apply to informational or transactional communications regarding the Services or other communications that have their own unsubscribe method.

Interest-Based Advertising Choices. You may see our ads on other websites or apps because we use third-party ad services as part of our online services. Through these ad services, we tailor our messaging to individuals considering demographic data, inferred interests, and browsing context. These ad services track information about your online activities over time and across third-party websites and apps by collecting information through automated means, including through the use of cookies, web server logs, web beacons, and other similar technologies, such as described in the Automated Data Collection section. These services may collect data about your interactions with us online, including visits to our websites or social media pages, such as the pages or ads you view and the actions you take on the websites or apps. This data may include contact information, commercial information, device data, online activity information, location data, demographic data, and interests and preferences.

Access, Correction, Deletion, and Other Rights. Depending on where you reside, you may have the right to request access to, or correction or deletion of, your personal data. To submit an access, correction, or deletion request, please email us at newsletter@313presents.com. In addition, subject to applicable law, you may receive, in a structured and commonly-used format, certain of your personal data that you have provided to us. To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal data or complying with your deletion or correction request. We may verify your identity by requiring you to authenticate the email address you use to make the request or provide information about your prior transactions or interactions with us

California Resident Rights. In accordance with the California Consumer Privacy Act (“CCPA”), California residents have the right to request that we disclose information about our collection and use of personal information and to request access to their personal information. California residents also have the right to request that we correct or delete personal information in certain circumstances. In accordance with applicable law, there may be certain circumstances in which we will not be able to honor your requests, as these rights are not absolute. For example, we may need to retain your information to protect the security or functionality of our operations, to service your account, or to comply with legal obligations.

To ask for a record of the information we hold about you, or to ask us to correct or delete your information, please email us at newsletter@313presents.com. You must provide enough information about who you are and that you are a California resident. We may request further information from you to verify your request, such as your account details and, where necessary, information about your interactions with us.

To the extent applicable to the Services, California residents also have the right to direct us not to sell their personal information. You may submit a request to opt out of the sale of your personal information by emailing us at newsletter@313presents.com. You must provide enough information about who you are and that you are a California resident. California residents may also opt-out of the sharing of your personal information for purposes of interest-based advertising by clicking the “Do Not Sell or Share My Personal Information” link. As noted above, you can also opt out of interest-based advertising from participating companies as described in the “Managing Cookie Technologies” section of this Policy.

We will not charge you different prices or provide different quality of services simply because you have exercised your California privacy rights except where allowable under California law. You may have the right to designate an authorized agent to make any of these requests under the CCPA on your behalf.

Other choices. You also have choices about the data you provide directly to us when you register for or use the Services. Please note, however, that if you choose not to provide data that is necessary to provide certain features of the Services, your use of the Services may not include those features.

You can choose not to share certain location data by adjusting the settings on your device. Please note, however, that if you choose not to share this data, you may not be able to access or use location-based Services.

Third-Party Products and Services might make certain choices available to you. For example, you may be able to choose to limit the data that third-party services (e.g., social media platforms) share with us using the options provided to you by the applicable third-party service (for example, the options provided by a third-party social media platform when you connect your social media account with the Services). You also may be able to choose to disconnect your use of the Services from a Third-Party Product and Service at any time using the options provided to you by the applicable third-party service. Please note, however, that if you disconnect from the third-party service, that will not delete the data we may have previously collected while you were connected.

9. Cookies and Similar Technologies

We, and third parties that provide content, functionality, or advertising in relation to the Online Services, collect information about your internet and electronic network activity through cookies, pixels, local storage, and other similar technologies (collectively, “Cookie Technologies”). These Cookie Technologies include, for example:

  • Cookies. Cookies are small text files that are unique to your device or browser. They can either be session-based (i.e., lasting only while your browser is open and automatically deleted when you close your browser) or persistent (i.e., lasting until you delete them or they expire). Cookies can serve many useful purposes. For example, cookies can remember your sign-in credentials so you do not have to enter those credentials each time you visit a Service, and cookies can help us and third parties understand which parts of the Services are the most popular, because they help us see which pages and features visitors access and how much time they spend on the pages. Most web browser settings give you the ability to manage browser-based cookies used on a website, including blocking or deleting them.
  • Locally stored objects. Locally stored objects (“LSOs”), also commonly called “Flash cookies,” are stored on your device or browser to provide services that use Adobe Flash technology. For Flash cookies, you can access Flash management tools from Adobe’s website. In addition, some, but not all, browsers provide the ability to remove LSOs within cookie and privacy settings.
  • Web beacons. “Web beacons”(also referred to as pixel tags or clear GIFs) are small pieces of code placed on a website or within the body of an email for the purpose of tracking activity on websites, or when emails are opened or accessed, and are often used in combination with cookies.
  • Software development kits. Mobile Software Development Kits (“SDKs”) are bits of computer code used by mobile app developers to enable or enhance various features of a mobile app. For example, an app developer may include an SDK within a mobile app that enables advertisements to be shown, data to be collected, and related services or analytics to be performed in connection with a mobile app.

In some cases, we may work with third parties (for example, third-party operators of the Services) to synchronize our unique, anonymous identifiers (such as those associated with Cookie Technologies) with the third party’s own identifiers. This enables us to better achieve each of the purposes described above.

Managing Cookie Technologies. Some of the third-party companies may participate in industry-developed programs designed to provide consumers choices about whether to receive interest-based advertising.

You also may be able to opt out of interest-based advertising and/or block Cookie Technologies by adjusting your device or browser settings. Please consult the support materials or privacy settings for your mobile operating system (e.g., iOS for Apple devices, Android for Android devices and Windows for Microsoft devices) for instructions on how to prevent the delivery of interest-based in-application advertisements. For other devices, please visit the privacy settings for the applicable device or contact the applicable platform operator.

Please note that if you choose to block Cookie Technologies, you may not be able to use certain features that depend on those Cookie Technologies (such as keeping you signed in or remembering your preferences). If you choose to delete Cookie Technologies, any settings and preferences that were associated with those Cookie Technologies also will be deleted. Opting out of interest-based advertising or Cookie Technologies does not mean you will stop seeing, or see fewer, advertisements. It does, however, mean that the advertisements you do see will not be interest-based and may be less relevant to your interests.

Do Not Track. Some browsers have incorporated “Do Not Track” features that send an automated signal to the websites that you visit using that browser. Our Online Services may not recognize or respond to these signals. However, you can adjust your preferences regarding the data we collect using the tools and methods described above.

10. Security of Data

313 Presents takes security seriously. We take many steps to protect your data from unauthorized access, use, or disclosure. However, it is important to remember that no system can be guaranteed to be 100% secure. We recommend that you help us keep your data safe by taking reasonable steps such as keeping your passwords private and not disclosing sensitive personal data in places that can be accessed publicly.

11. Children and Parents

Although customers of all ages may attend some events held by 313 Presents, the Services are not directed at children under the age of 16, and our policy is to not knowingly collect personal data from children under the age of 16. For certain activities in which children are allowed to participate, any request for personal data is intended for and directed to the parent or legal guardian.

If you have reason to believe that a child under the age of 16 has provided personal data to us without parental consent, please contact us by using any of the methods described in the “How to Contact Us” section of this Policy, and we will endeavor to delete that data from our systems in accordance with applicable law.

12. Storing & Retaining Data

The personal information we collect will be retained for so long as we determine reasonably necessary for the purposes set out in this Policy, in accordance with applicable laws. When determining retention of personal information, we take into account the length of time personal information is required to be retained to provide the services; satisfy legal and compliance obligations and for audit purposes; address any complaints regarding the services; address any relevant litigation or regulatory investigations; and defend or bring potential legal claims.

By providing personal data in connection with the Online Services and Services, you acknowledge and consent that such personal data may be transferred from your current location to the offices and servers of 313 Presents, its affiliates, NBA Entities, NHL Entities, MLB Entities, and/or our authorized third-party service providers located in the United States and elsewhere.

13. Changes to This Privacy Policy

We may change this Policy from time to time to reflect changes in our business, the Services, or our practices and procedures. If we do make changes, we will post any changes on this page and indicate the date on which the Policy was last revised but we will not otherwise contact you regarding the changes in this Policy. By using our Services, you hereby consent to any such changes made to this Policy. We encourage you to review this Policy periodically, especially before you provide personal data directly to us through the Services.
